Welcome to Siren NYC Building Reports ("Siren"). By accessing or using this website, you agree to the following terms and conditions ("Terms"). If you do not agree to these Terms, please do not use the service.

1. Acceptance of Terms
By accessing or using Siren, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, you may not access the service. These Terms apply to all users, including browsers, customers, and contributors of content.
2. Use of the Service
Siren provides building data and analytical reports sourced from public records and third-party APIs.The information is offered for general informational purposes only and should not be considered legal, financial, real estate, safety, or professional advice.
You acknowledge and agree that:
- Building scores, health checks, and analyses do not guarantee safety, habitability, or quality
- Data may be outdated, incomplete, or contain errors
- You are solely responsible for any decisions or actions you take based on the information provided
- Professional inspection and verification is strongly recommended before making housing decisions
- Past data does not predict future conditions or guarantee outcomes
3. User Responsibilities and Prohibited Uses
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to our systems or user accounts
- Use automated systems to scrape, mine, or harvest data from our service
- Interfere with or disrupt the service or servers connected to the service
- Transmit any viruses, malware, or other harmful code
- Misrepresent your identity or provide false information
- Use our data to harass, discriminate against, or harm any individual or group
- Redistribute or resell our data without explicit written permission
4. Purchases and Payments
Paid reports and subscriptions may be purchased through our payment provider (Stripe).All sales are final once the report is delivered or subscription is activated.Prices and features are subject to change at any time without notice.
You are responsible for all charges incurred under your account. Disputed charges must be reported within 30 days of the transaction.
5. User Indemnification
You agree to indemnify, defend, and hold harmless Siren, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:
- Your use of or inability to use the service
- Your violation of these Terms
- Your violation of any rights of another party
- Any decisions made based on information from our service
- Any housing, investment, or other decisions influenced by our data
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.We do not warrant that the information is accurate, complete, current, or reliable. To the fullest extent permitted by law, Siren disclaims all warranties, express or implied, including:
- Warranties of merchantability and fitness for a particular purpose
- Warranties of non-infringement
- Warranties that the service will be uninterrupted or error-free
- Warranties regarding the accuracy, reliability, or completeness of data
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- Siren will not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability will not exceed the amount you paid for the service in the 12 months preceding the claim
- We are not responsible for any decisions made based on our information
- We disclaim liability for: financial losses, property damage, personal injury, or any harm resulting from housing decisions
- Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so these limitations may not apply to you
8. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY – IT AFFECTS YOUR LEGAL RIGHTS
Agreement to Arbitrate: You and Siren agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service will be settled by binding arbitration, rather than in court, except for certain limited circumstances.
Class Action Waiver: You and Siren agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Arbitration Rules: The arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and will be held in New York County, New York.
Exception for Small Claims: Either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction.
30-Day Right to Opt Out: If you don't want to be bound by arbitration, you must notify us in writing within 30 days of first accepting these Terms.
9. Intellectual Property
The service and its original content, features, and functionality are owned by Siren and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from our content.
10. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices. By using our service, you consent to the collection and use of information in accordance with our Privacy Policy.
11. Termination
We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will cease immediately.
12. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. Continued use of the service after changes are posted constitutes your acceptance of the revised Terms.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding (not subject to arbitration) shall be brought exclusively in the federal or state courts located in New York County, New York.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. This Terms agreement constitutes the entire agreement between us regarding our service and supersedes all prior agreements.
